The second meeting of the Advisory Board on the Protection of the Rights of Entrepreneurs and Investors at the Prosecutor General’s Office of the Kyrgyz Republic

On April 26, 2023, the second meeting of the Advisory Board on the Protection of the Rights of Entrepreneurs and Investors at the Prosecutor General’s Office of the Kyrgyz Republic was held at the General Prosecutor’s Office of the Kyrgyz Republic. The meeting was attended by the Prosecutor General, Kurmankul Zulushev, the Chairperson of the Board of Directors of the American Chamber of Commerce in the Kyrgyz Republic, Nazira Beishenalieva, the Acting Business Ombudsman, Nurlan Musuraliev, the representatives of the executive branch and representatives of leading business communities.

The creation of the Advisory Council aims to build an effective mechanism for interaction between the state and the business community in protecting the rights of entrepreneurs and investors. The Advisory Council was established last year by decision of the General Prosecutor of the Kyrgyz Republic as part of the implementation of the tasks set forth in the Presidential Decree “On the Protection of Property and Support for Entrepreneurs and Investors” of January 29, 2021, No. 3.

The Advisory Council has already done significant work to identify systemic problems that lead to violations of the rights and legitimate interests of business entities and to develop specific recommendations for their elimination.

As a result of the activities of the Advisory Council and the joint work of the General Prosecutor’s Office and the business community, the automated information system “Registration of Checks of Business Entities” (AIS “RPSP”) and the mobile application “Business Protection” were developed. These tools provide electronic registration of business checks, essentially serving as an effective instrument for eliminating unjustified intervention by law enforcement and tax authorities in business activities, strengthening their legal protection, and creating a favorable business and investment environment.

At the end of the Advisory Council meeting, an Action Plan for 2023 was approved, which includes measures to include all types of tax control in the list of registered checks by the prosecutor’s office, to prevent the initiation of criminal cases on issues that should be resolved in a civil or administrative manner, and to combat smuggling.

It is worth noting that this platform was created at the initiative of the General Prosecutor’s Office, the American Chamber of Commerce in the Kyrgyz Republic, and the Business Ombudsman Institute.
